General Terms and Conditions of Sale

These terms and conditions of sale are entered into on the one hand by the company K3D (hereinafter referred to as "solu.fr"), a limited liability company with a capital of 200,000 euros, registered under SIRET number 499 312 023, whose registered office is located at 3850 route de Saint Claude Huissel, 69550 Amplepuis, and on the other hand by any natural or legal person (hereinafter referred to as "the buyer") wishing to make a purchase via the website solu.fr.

Object

These general terms and conditions of sale (GTC) are intended to define the rights and obligations of the parties in the context of the sale of products and services by solu.fr to the buyer, carried out via the solu.fr website.

Any order placed on the site implies full and unreserved acceptance of these Terms and Conditions, which prevail over any other document emanating from the buyer, unless otherwise agreed in writing by solu.fr.

Geographic area

Online sales of the products and services presented on the solu.fr website are reserved for buyers residing in mainland France, Belgium, and Switzerland. For all other destinations, buyers are invited to contact customer service by telephone at +33 4 74 05 25 56 or by email at info@k3d.fr to discuss the possibility of special shipping arrangements.

Regulated products (biocides, plant protection products, marketing authorizations)

Some products offered on the site are subject to specific regulations (biocidal products, plant protection products, products with a marketing authorization – AMM, adjuvants, etc.).

The buyer expressly acknowledges that:

  • The use of these products must comply with current regulations, the information on the label, official instructions and the marketing authorization where applicable;
  • It is his responsibility to verify, before any order, that the product is suitable for the intended use and the conditions of use (culture, environment, type of pest, etc.);
  • any non-compliant, misuse or professional use when the product is intended for the general public, engages its sole responsibility;
  • The information, advice and content on this site are in no way a substitute for official recommendations from the competent authorities or for instructions provided by manufacturers.

solu.fr (K3D) cannot be held responsible for any damage resulting from improper use, incorrect application, failure to comply with doses or conditions of use, or any misuse of regulated products.

Professional use prohibited

Products intended for the general public are not for professional use. Any commercial, agricultural, or service-related use is strictly prohibited when the product is intended for domestic use. The buyer agrees to use these products solely for domestic purposes and at their own risk.

Characteristics of the goods and services offered

The products and services offered are those listed in the catalogue published on the solu.fr website, subject to availability.

solu.fr strives to present and describe products as accurately as possible. However, photographs, texts, and descriptions are for illustrative purposes only and are not contractually binding. Differences in presentation (color, packaging, evolving visual appearance) cannot, under any circumstances, render solu.fr liable, nor justify a refusal of delivery or a claim for compensation, provided that the product received conforms to its intended use and commercial name.

Prices

The prices shown on the website are in euros, inclusive of all taxes (VAT included), including the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products.

solu.fr reserves the right to modify its prices at any time, while guaranteeing the buyer the application of the price in effect at the time of validation of their order.

Delivery charges and any other applicable fees are clearly indicated before final order confirmation.

Orders

To place an order, the buyer must follow the online ordering process. Specifically, they must:

  • fill out the identification form by providing the requested contact details;
  • fill the basket by choosing the desired products;
  • check the details of your order and correct any errors;
  • confirm your order and accept these Terms and Conditions;
  • proceed with payment under the conditions stipulated.

The buyer's final order confirmation constitutes express acceptance of the prices, the selected products, and these General Terms and Conditions of Sale. All data provided and the confirmation recorded by solu.fr will serve as proof of the transaction.

Payment methods

The price is due upon ordering.

Payment is made by credit card, via a secure payment solution, by PayPal or by any other payment method offered on the site at the time of ordering.

Transactions are secured using encryption methods that comply with current standards. solu.fr never has access to the buyer's full bank details and does not store them.

Deliveries

Products are delivered to the address provided by the buyer when placing the order, who is responsible for ensuring the accuracy of their information. In the event of an error or incomplete address, any additional costs (redelivery, rerouting, return of the package) may be charged to the buyer.

In accordance with Articles L.216-1 et seq. of the Consumer Code, the transfer of risks takes place upon physical delivery of the products to the buyer or to a third party designated by him (other than the carrier).

In the event of a non-delivered package or a delivery problem, the buyer must report the incident within a reasonable timeframe, compatible with the carriers' investigation times (in practice, generally a maximum of 30 to 45 days from the scheduled delivery date). Beyond these timeframes, as the carriers no longer retain tracking information, no claim or investigation can be processed.

Unclaimed, refused or returned packages

Any unclaimed package, refused without legitimate reason, or returned due to an incomplete or incorrect address, or an inability to deliver, will be automatically returned to solu.fr. In this case:

  • Only products returned in perfect condition may be eligible for a refund.
  • The buyer will be entirely responsible for the costs of both the initial and return shipping.
  • No additional compensation or indemnity may be claimed.

Such a situation does not constitute a retraction in the legal sense.

Delivery Delays – Force Majeure

Delivery times are indicative. No reasonable delay shall, in itself, give rise to damages, order cancellation or withholding of payment by the buyer, provided that delivery takes place within a period in accordance with legal provisions.

The following are considered cases of force majeure, which have the effect of suspending or cancelling the obligations of solu.fr, without any fault on its part:

  • exceptional weather conditions, natural disasters,
  • strikes (transport, logistics, postal services, etc.),
  • computer failures, cyberattacks, network outages,
  • supply disruptions, shortages, administrative blockages,
  • incidents or accidents in transport beyond the seller's control.

Withdrawal

In accordance with Articles L.221-18 et seq. of the Consumer Code, the consumer buyer has a period of 14 days from the receipt of his order to exercise his right of withdrawal, without having to justify a reason or pay a penalty, with the exception of the return costs which remain his responsibility.

However, the right of withdrawal cannot be applied in cases provided for by law, and in particular for:

  • goods unsealed by the consumer and which cannot be returned for reasons of hygiene or health protection;
  • goods that are likely to deteriorate or expire rapidly;
  • certain regulated products (biocides, plant protection products, etc.) when the packaging has been opened and the product is no longer suitable for resale;
  • Products made to consumer specifications or clearly personalized.

When the right of withdrawal is exercised within the legal period, solu.fr will reimburse the buyer within a maximum period of 14 days from the receipt of the returned products in good condition, by the same means of payment as that used when ordering, unless the buyer expressly agrees to another method of reimbursement.

Legal guarantees

The products benefit from the legal guarantees of conformity and against hidden defects, under the conditions provided for by the applicable laws.

Under the legal guarantee of conformity (articles L.217-3 to L.217-20 of the Consumer Code), the buyer has two years from the date of delivery of the goods to take action. They can have the product brought into conformity, free of charge.

Under the warranty against hidden defects (articles 1641 et seq. of the Civil Code), the buyer may, within two years of discovering the defect, request either the cancellation of the sale or a reduction in the sale price, if the defect renders the product unfit for its intended use or diminishes its use to such an extent that the buyer would not have acquired it, or would have paid a lower price, if he had been aware of it.

Liability and limitation of liability

solu.fr is only bound by an obligation of means. It cannot be held liable for damage resulting from improper use of the products, failure to comply with applicable regulations, instructions or recommendations for use, nor for indirect damage.

solu.fr cannot be held responsible under any circumstances:

  • indirect or intangible damages (loss of time, loss of business, loss of use, etc.),
  • damage resulting from misuse of the products,
  • the consequences of improper storage or storage contrary to instructions,
  • unforeseen reactions or effects related to the conditions of application,
  • third-party interventions or actions independent of the seller's will.

solu.fr cannot be held responsible for any inconvenience or damage inherent in the use of the Internet network, including service interruptions, external intrusions or the presence of computer viruses.

Retention of title

In accordance with Article 2367 of the French Civil Code, solu.fr retains full ownership of the products until full payment of the price. The transfer of risk occurs upon physical delivery of the package to the buyer.

Accuracy of information provided by the buyer

The buyer is solely responsible for the accuracy of the information provided when placing the order (address, name, telephone number, accessibility, choice of collection point). The seller cannot be held liable for any errors resulting in delays, lost packages, or returns.

Intellectual property

All elements of the solu.fr website (texts, comments, works, illustrations, images, logos, databases, software, etc.) are protected by copyright, trademark law, and/or any other intellectual property rights. They are and remain the exclusive property of K3D or its partners.

Any reproduction, representation, exploitation, redistribution or use, even partial, of all or part of the site or its elements, by any means whatsoever, without the prior written authorization of K3D, is strictly prohibited.

Personal data

The personal information collected during orders or via the site is subject to processing in accordance with the regulations in force, in particular Regulation (EU) 2016/679 (GDPR) and the amended "Data Protection Act".

The data collected is used for order management, invoicing, delivery, customer relations and, where applicable, sending marketing information if the buyer has consented. solu.fr undertakes not to transfer the personal data of its customers to unauthorized third parties.

In accordance with regulations, the buyer has the right to access, rectify, erase, limit, object to, and transfer their data. They can exercise these rights by contacting solu.fr at the following email address: info@k3d.fr.

Archiving - Proof

solu.fr will archive order forms and invoices on a reliable and durable medium, in accordance with applicable legal provisions. The computerized records of solu.fr, stored under security conditions compliant with current standards, will be considered by the parties as proof of communications, orders, payments, and transactions between them.

Consumer dispute mediation

In accordance with Articles L.612-1 et seq. of the French Consumer Code, in the event of a consumer dispute, the buyer has the right to use a consumer mediator free of charge to attempt to resolve the dispute amicably with our company. To this end, we have partnered with SAS MEDIATION SOLUTION.

Dispute resolution

These general terms and conditions of sale are governed by French law.

In the event of a dispute and failing an amicable settlement, jurisdiction is granted to the territorially competent French courts, notwithstanding multiple defendants or third-party claims.
